Article 2 – Applicability
These terms and conditions apply to all quotations, agreements, and deliveries of services and/or works by Jan Truyens. Deviations are only valid if agreed upon in writing.
Article 3 – Quotations and Prices
All quotations are without obligation and valid for 30 days, unless stated otherwise.
Prices are quoted in euros, excluding VAT if applicable.
Costs for shipping, carriers (paper, canvas, digital files), or additional services are not included, unless otherwise agreed.
Article 4 – Execution of Assignments
Jan Truyens will carry out the assignment to the best of his knowledge and ability.
Delivery times are indicative and not binding, unless expressly agreed in writing.
Digital files will be delivered in the agreed formats. Physical works will be shipped or made available for collection after full payment has been received.
Article 5 – Copyright and Usage Rights
All works created by Jan Truyens (illustrations, drawings, paintings, designs, etc.) are protected by copyright and remain the property of Jan Truyens.
The client only obtains a right of use for the purpose and scope expressly agreed in writing (for example: publication in a book, online use, promotional campaign).
Any other use, reuse, modification, reproduction, or transfer to third parties is not permitted without prior written consent.
Unless otherwise agreed, Jan Truyens retains the right to use the work in portfolios, on the website, on social media, and in exhibitions.
In case of copyright infringement, Jan Truyens may claim compensation of at least three times the agreed fee, without prejudice to the right to recover the actual damage suffered.
Article 6 – Payment
For assignments, Jan Truyens may request a 50% advance payment before starting execution.
Payments must be made within 30 days of the invoice date.
In case of late payment, default interest of 8% per year will be due by operation of law and without notice of default, increased by a fixed compensation of 10% of the invoice amount with a minimum of €40.
The work remains the property of Jan Truyens until full payment has been received.
Article 7 – Cancellation and Changes
If the client cancels an assignment after confirmation, the client is obliged to reimburse all costs incurred and work already performed.
Changes or additional revision rounds beyond the original agreement will be charged separately.
Article 8 – Liability
Jan Truyens is not liable for incorrect use of the delivered work by the client.
Jan Truyens guarantees that the delivered work is original and does not infringe the rights of third parties.
Any liability is limited to the amount invoiced for the assignment. Indirect damages (loss of income, reputational damage, consequential damages) are excluded.
Article 9 – Force Majeure
In the event of force majeure (such as illness, technical problems, fire, flooding, strike, etc.), Jan Truyens has the right to postpone the execution of the assignment or to dissolve the agreement without the client being entitled to compensation.
Article 10 – Applicable Law and Jurisdiction
This agreement is exclusively governed by Belgian law.
Any disputes fall under the exclusive jurisdiction of the courts of the district in which Jan Truyens is established.
